Terms of Service

Welcome to FursonaAI. These Terms of Service ("Terms") govern your use of fursonaai.com and the services we provide. By using our service or placing an order, you agree to these Terms.

Please read carefully. If you do not agree, do not use our service.

1. Who We Are

FursonaAI ("we", "our", "us") is a service that creates AI-generated pet portraits from photos you upload. We are based in Sydney, NSW, Australia. For questions about these Terms or any order, contact us at hello@fursonaai.com.

2. Eligibility

To use FursonaAI, you must:

  • Be at least 18 years old, or have a parent or legal guardian agree to these Terms on your behalf.
  • Have the legal capacity to enter into a binding contract.
  • Not be barred from using our service under Australian or other applicable law.

By using the service, you represent that you meet these requirements.

3. The Service

FursonaAI lets you upload a photo of your pet, generates an AI portrait in our signature Royal Renaissance style (King or Queen variant), and provides a watermarked preview. If you choose to purchase, we deliver:

  • A digital portrait pack (high-resolution wallpaper, Instagram-format crop, certificate of authenticity).
  • Optionally, a physical print or framed print, manufactured and shipped by our print partner.

The preview is free. You only pay if you decide to keep the portrait.

4. Your Account and Orders

You do not need an account to use FursonaAI. Orders are linked to the email address you provide at checkout.

You are responsible for:

  • Providing accurate information at checkout, including a correct email and (for physical orders) shipping address.
  • Keeping your download links secure. Anyone with the link can access your files.
  • Reviewing your order before paying. Once an order is placed and processing begins, changes may not be possible.

We are not liable for losses caused by inaccurate information you provide.

5. Photo Upload Requirements and Acceptable Use

You may only upload photos that meet ALL of the following conditions:

  • The photo features a domestic pet (dog, cat, rabbit, or similar companion animal).
  • You own the photo or have permission from the photographer to use it.
  • The photo does not contain any of the prohibited content listed below.

You must NOT upload:

  • Photos that primarily feature humans, including selfies, family photos, or images where a human face is the main subject.
  • Photos of children, even if a pet is also in the frame.
  • Photos containing recognisable copyrighted characters, branded mascots, logos, or other intellectual property you do not own (for example, Disney, Marvel, or sports team imagery).
  • Photos of celebrities, public figures, or any identifiable person without their consent.
  • Sexually explicit, suggestive, or nude content of any kind.
  • Violent, gory, or otherwise disturbing imagery.
  • Photos used to deceive others or misrepresent the subject.
  • Photos of wild, dangerous, exotic, or endangered animals (we may permit these at our discretion; contact us before ordering).
  • Any content that is illegal, infringes third-party rights, promotes hate, harassment, or harm, or violates our AI provider's content policy.

We use automated and manual systems to detect prohibited content. We may refuse to process, cancel, or delete any order that we believe violates these requirements, in our sole discretion. If we cancel an order under this clause, we will refund the purchase price minus a small processing fee where applicable.

You are solely responsible for the photos you upload and any consequences arising from them.

6. Pricing and Payment

All prices are displayed in your local currency where supported. Prices include applicable taxes unless stated otherwise.

We accept payment via the methods shown at checkout. Payment is processed by a PCI DSS Level 1 certified payment provider. We do not store your full card number, CVV, or bank details.

We may change prices at any time, but the price you pay is the price displayed at the moment you complete checkout.

If your payment fails or is reversed (chargeback) after delivery of digital files, you authorise us to revoke access to your downloads and pursue recovery through standard means.

7. Digital Portrait Delivery

Once payment is confirmed, we begin processing your digital portrait pack. Delivery is by email to the address you provided at checkout, typically within minutes but occasionally up to 24 hours during high-volume periods.

Each digital order includes:

  • A high-resolution unwatermarked portrait
  • A mobile wallpaper format
  • An Instagram-format square crop
  • A personalised certificate of authenticity (PDF)

Download links are valid for 30 days from the date of email delivery. If your link expires or you cannot access your files, contact hello@fursonaai.com and we will reissue access at no charge for up to 2 years from your order date.

If you do not receive your delivery email within 24 hours, check your spam folder and then contact us. We will reattempt delivery and, if necessary, resend manually.

8. Physical Print Delivery

Physical prints and framed prints are manufactured on demand by our print partner and shipped directly to you.

Estimated delivery times:

  • Production: 2 to 5 business days from order confirmation
  • Shipping: 5 to 9 business days standard delivery

Delivery times are estimates, not guarantees. Most orders to Australia, the United States, the European Union, and the United Kingdom arrive within these windows thanks to local production hubs. Orders to other regions may take longer (up to 21 business days). If we become aware of significant delays affecting your order, we will notify you.

You are responsible for providing a complete and accurate shipping address. If a parcel is returned to sender, refused, or unclaimed due to address error or non-collection, you may be required to pay reshipping costs to receive a replacement.

Risk of loss for physical products passes to you when the product is delivered to the address you provided. We are not responsible for theft, weather damage, or other loss after delivery.

9. Refunds and Quality Guarantee

Digital portraits

Because you receive a watermarked preview before paying, all digital sales are final. We do not offer refunds on digital portraits except where required by Australian Consumer Law or equivalent consumer law in your jurisdiction.

If you experience a technical issue receiving or downloading your files, contact us and we will resolve it.

Goodwill regeneration

We understand that AI generation can occasionally produce results that look great in preview but reveal issues at full resolution (for example, a small artifact that wasn't visible in the preview).

We may, at our sole discretion, offer one complimentary regeneration if you contact us within 7 days of purchase with a specific issue you can point to in the delivered file. This is a goodwill gesture, not an entitlement, and is not a substitute for the refund rights described above.

We will not offer regenerations for:

  • Subjective preferences ("I wish the crown was bigger", "the colours don't match my couch").
  • Issues that were already visible in the preview you approved.
  • Repeated requests on the same order.

Physical prints

If your print arrives damaged, defective, or printed incorrectly, contact us at hello@fursonaai.com within 14 days of delivery. Include your order number and clear photos showing the issue. We will, at our discretion, arrange a free replacement or refund the product cost.

This guarantee does not cover:

  • Minor variations in colour, contrast, or tone between your screen preview and the physical print. Printing is a chemical process and absolute consistency is not possible. These variations fall within industry-standard tolerance and are not considered defects.
  • Damage caused after delivery (handling, framing, weather, accidents).
  • Issues resulting from the quality of the photo you uploaded (blurry, low-light, low-resolution, or watermarked source photos).
  • Address errors, rejected deliveries, or unclaimed parcels.
  • Lost packages where tracking shows delivery completed.

Nothing in this section limits or excludes any rights or remedies you may have under Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any equivalent consumer law in your jurisdiction. Our goods come with guarantees that cannot be excluded under Australian Consumer Law.

10. Intellectual Property and Licence to Use Your Portrait

Your photo

You retain all rights in the photo you upload. By uploading, you grant us a limited, worldwide, royalty-free licence to use the photo solely for the purpose of generating, processing, and delivering your portrait, and for internal quality assurance and fraud prevention. We do not share or sell your photos to third parties.

Your portrait

When you complete payment, we grant you a perpetual, worldwide, non-exclusive, non-transferable licence to use your generated portrait for personal, non-commercial purposes only.

You MAY:

  • Print the portrait for personal display in your home.
  • Share the portrait on personal social media accounts.
  • Use the digital files as wallpapers or personal screen backgrounds.
  • Give the portrait as a gift to friends or family for personal use.

You MAY NOT:

  • Sell, license, sublicense, or otherwise commercialise the portrait or any derivative of it.
  • Use the portrait in any commercial product, advertising, or promotional material.
  • Use the portrait to create merchandise for resale.
  • Mint the portrait as an NFT or any other tokenised digital asset.
  • Use the portrait in any way that would compete with FursonaAI or our services.

FursonaAI retains all underlying intellectual property rights in the portrait, the Royal Renaissance style, our prompts, our pipeline, and all related materials. The licence granted above does not transfer ownership.

11. Prohibited Conduct

You agree not to:

  • Reverse engineer, scrape, or extract data from our service.
  • Use bots, scripts, or automated tools to interact with the service.
  • Attempt to bypass our watermarking, paywall, or any other technical protection.
  • Re-upload, resell, or share watermarked previews as if they were finished products.
  • Submit fraudulent payment information or initiate fraudulent chargebacks.
  • Misrepresent yourself, impersonate others, or upload content on behalf of someone without their permission.
  • Interfere with the security or operation of the service.
  • Use the service to violate any law, regulation, or third-party right.

We may suspend or terminate access to anyone we reasonably believe is engaging in prohibited conduct.

12. Service Availability

We aim to keep the service available at all times but cannot guarantee uninterrupted access. Maintenance, technical issues, or factors outside our control may cause temporary unavailability.

We may modify, suspend, or discontinue any part of the service at any time, with or without notice. If we permanently discontinue the service, we will provide reasonable advance notice and honour outstanding orders to the extent possible.

13. Disclaimers

Except as expressly stated in these Terms or required by law:

  • The service is provided "as is" and "as available", without warranties of any kind.
  • We do not warrant that AI-generated portraits will meet your subjective expectations. Style, likeness interpretation, and artistic outcome are inherent to AI generation. The watermarked preview is your opportunity to evaluate before paying.
  • We do not warrant that the service will be uninterrupted, error-free, or free from viruses or harmful components.

Nothing in this section excludes any consumer guarantee, warranty, or right that cannot lawfully be excluded under Australian Consumer Law or equivalent consumer law in your jurisdiction.

14. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the service.
  • Our total liability to you for any claim arising out of or relating to the service or these Terms is limited to the amount you paid us in the 12 months preceding the claim, or AUD 100, whichever is greater.

These limitations do not apply to liability that cannot be limited under Australian Consumer Law, including liability for fraud, gross negligence, or breach of non-excludable consumer guarantees.

Where Australian Consumer Law applies, our liability for breach of a non-excludable consumer guarantee is, at our option, limited to: (a) replacement of the goods or supply of equivalent goods; (b) repair of the goods; (c) payment of the cost of replacing the goods or acquiring equivalent goods; or (d) payment of the cost of having the goods repaired.

15. Indemnity

You agree to indemnify and hold us harmless from any claim, demand, loss, or damage (including reasonable legal fees) arising from:

  • Photos or content you upload.
  • Your breach of these Terms.
  • Your misuse of the service or your portrait.
  • Your violation of any third-party right (intellectual property, privacy, publicity, or otherwise).

16. Termination

You may stop using the service at any time.

We may terminate or suspend your access to the service, with or without notice, if you breach these Terms, engage in prohibited conduct, or for any other reason at our discretion. On termination:

  • Outstanding paid orders will be fulfilled to the extent reasonably possible.
  • Sections relating to intellectual property, indemnity, limitation of liability, and governing law survive termination.

17. Governing Law and Disputes

These Terms are governed by the laws of New South Wales, Australia. The Australian Consumer Law applies to all consumers in Australia.

For consumers outside Australia, the consumer protection laws of your country of residence may also apply, and nothing in these Terms limits any rights you have under those laws.

In the event of a dispute, please contact us first at hello@fursonaai.com so we can try to resolve it informally. If we cannot resolve the dispute within 30 days, either party may pursue legal action.

The exclusive jurisdiction for any legal action arising under these Terms is the courts of New South Wales, Australia, except where applicable consumer protection law gives you the right to bring proceedings in your country of residence.

18. Changes to These Terms

We may update these Terms from time to time. The current version will always be available at fursonaai.com/terms with the date of last revision at the top.

If we make material changes, we will notify you by email (for past customers) or through a prominent notice on the site. Continued use of the service after changes take effect means you accept the updated Terms.

19. Miscellaneous

  • Severability. If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
  • No waiver. Our failure to enforce any right or provision is not a waiver of that right or provision.
  • Entire agreement. These Terms, together with our Privacy Policy and Refund Policy, are the entire agreement between you and FursonaAI regarding the service.
  • Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
